Terms of Service
Last updated: [Date of publication]
These Terms of Service ("Terms") govern your use of the NetaWin platform. By creating an account, you agree to these Terms.
1. Eligibility
NetaWin is intended for use by individuals contesting or planning to contest elections in India, and their authorized campaign teams. We require identity verification (KYC) before granting full platform access, as an anti-fake-candidate safeguard — see our Pay-Before-Profile registration flow.
2. Subscription plans
Access to platform features is governed by your subscription tier. Feature availability, usage limits (AI credits, SMS quota, voter database size, agent seats), and pricing for each tier are shown on our Pricing page and enforced server-side.
3. Acceptable use
You agree not to use NetaWin to:
- Impersonate another candidate or spread knowingly false information about an opposing candidate.
- Violate the Model Code of Conduct or any applicable Election Commission of India regulation.
- Send unsolicited communications outside the consent scope you've collected from recipients.
- Circumvent the platform's silent-period (pre-poll blackout) publishing restrictions.
4. AI-generated content
Content generated using our AI tools passes through automated guardrails (fact-grounding checks, hate-speech detection, watermarking) but you remain solely responsible for reviewing and approving any content before it is published under your name.
5. Payments
Payments are processed via Razorpay. By subscribing, you authorize us to charge the applicable plan fee. See our Refund Policy for cancellation and refund terms.
6. Termination
We may suspend or terminate accounts that violate these Terms, applicable election law, or engage in fraudulent registration. You may request account deletion at any time, subject to legal record-retention requirements.
7. Limitation of liability
NetaWin is a campaign management tool, not a guarantee of election outcomes. We are not liable for indirect or consequential damages arising from platform use, to the maximum extent permitted by law.
8. Changes to these Terms
We may update these Terms from time to time. Continued use of the platform after changes constitutes acceptance.
9. Governing law
These Terms are governed by the laws of India, with courts at [Registered Jurisdiction] having exclusive jurisdiction.
